2 Women that took away Corona’s Crown

They say behind every man’s success is a woman. But with the recent fate of ex-Chief Justice Renato Corona, 2 woman became instruments for his downfall.

The recent decision passed by the Senate Impeachment Court convicting then Chief Justice Corona can be traced to the involvement of 2 ladies, former President Gloria Macapagal-Arroyo and Ombudsman Conchita Carpio-Morales.

It’s of public knowledge that Renato Corona is a close ally of the former President. He used to work with her in Malacañang until his appointment in the Supreme Court. And who would have not remember the issue of “mid-night appointment”, when Gloria Arroyo appointed then Associate Justice Renato Corona to be the Chief Justice following the retirement of Chief Justice Reynato Puno. That appointment, which was publicly questioned by many people and civil society groups but was later upheld by the Supreme Court saying judiciary is not covered by the election ban on appointments. From then on the SC under Chief Justice Corona was dubbed as Gloria Supreme Court as it was perceived, that GMA appointed Corona to protect her from possible cases to be filed against her once she step down Malacañang. And that midnight appointment also created the gap between the Chief Justice and current President Benigno S. Aquino III who during his oath taking did follow the tradition of swearing-in with the Chief Justice and instead ask then Associate Justice and now Ombudsman Carpio-Morales to take his oath.

The ill treatment of the president to Corona continued as the President consistently pronounced his “disgust” over Corona in several public speeches. But I think the one that culminated it all which led to Corona’s impeachment was the airport drama following the TRO issued by the Supreme Court with regards to the Arroyo’s travel.

No matter how Corona and his supporters relate his impeachment to the Hacienda Luisita issue, the issue on the TRO of GMA will still weigh more. Forgive me for my word, but I don’t think many people care much about that land in Tarlac than making GMA accountable. I think Filipino’s don’t care much about this land dispute but they are more interested in finding out how this government (who during campaign promised to go out after the corrupt officials of the government) will be able to held the former President accountable from all the allegations against her. If it’s only about Luisita, do you think 188 of the Congressmen and women will support it? Should these Representatives be swayed to signed the impeachment complaint if it’s only about the President taking vengeance over their Hacienda? I don’t think so, because people’s clamor gained height during the airport fiasco. It was Corona led SC’s decision over GMA’s TRO that ignited it all. Take note of the dates when it transpired, it was after that TRO when the Lower House moved to file the complaint and collected 1/3 of the votes. If it’s not for that I don’t think there will be much support from the House of Representatives. It was his perceived bias to Gloria Macapagal-Arroyo led him to the Impeachment Trial.

During his trial, it was another woman who came out to be a big factor on his fate. As oppose to Gloria, this lady is not on his side but against his. At the start of his Impeachment Trial in Senate, it seemed that the prosecution might loose it’s case because of its lackluster performance. But not until the defense themselves presented as hostile witness, the Ombudsman Conchita Carpio-Morales. It seemed it was a great blunder for the defense to have called the Ombudsman to the witness stand and it indeed was proven. It’s like they’ve brought a bomb that exploded in-front of their face. They seemed caught surprised about the documents brought by Carpio-Morales from the AMLC detailing Corona’s 82 Dollar bank account amounting to 10-12 million in transactional balance. Her testimony became the turning point or game changer of the whole impeachment proceedings. The documents presented by Carpio-Morales along with her Powerpoint presentation became a strong evidence that was later considered by the Senator Judges in making their conviction vote. Although the defense argued that what she presented was mere scrap of paper having no authentication marks whatsoever, still they weren’t able to debunk her testimony by mere testimonial by Chief Justice himself. They’ve tried to attack the credibility of Carpio-Morales by presenting Corona himself at the witness stand to falsify all that she said but they failed. Could they’ve presented bank documents that will counter all that Carpio-Morales has testified it could have been better. But what they did was just to bank on the credibility of Corona saying and telling his version of the story without any documentary support. If you were the judge who would you believe more, the ‘untainted’ Carpio-Morales carrying the AMLC documents on her hand, or the accused Chief Justice with no one to present but his story and his wheelchair?

It was really an unfortunate fate for the former Chief Justice Renato Corona. Two woman has caused him his crown in the judiciary. And it will be forever in his memory, that once in his lifetime his closeness to one lady and his gap with another has led to his conviction and his eventual downfall.

Day 44 : Senate Impeachment Court Convicts Chief Justice Corona (Corona Impeachment Trial)

After more than 5 months of grueling trial, the Impeachment trial of the Chief Justice Renato Corona has finally came to its end. 23 Senators are present and have voted either to convict or acquit the accused Chief Justice.

The promulgation started with the prayer of Sen. Manny Villar then followed after by the open voting in alphabetical order. Each Senators are supposed to cast their votes and chose to explain it for 2 minutes but the presiding officer Senate President Juan Ponce Enrile ruled to have no time limit for their explanation. Sen.Edgardo Angara open the voting and ended by the presiding officer Senate President Juan Ponce Enrile.

And after the voting, the Senate Impeachment Court finds the respondent Chief Justice Renato C. Corona Guilty of the Article II of the Articles of Impeachment which is Culpable Violation of the Constitution and Betrayal of Public Trust for failure to disclose his Statement of Assets Liabilities and Networth. Day 40 : Chief Justice Renato Corona Testified (Corona Impeachment Trial)

The much awaited witness in the impeachment trial has finally took the witness stand. The accused Chief Justice Renato Corona was presented today by the defense panel as their last witness.

At past 2PM, Corona took the witness stand but before the trial started, he ask the permission of the presiding judge Senator Juan Ponce – Enrile if he can read his opening statement to which Enrile permitted.

Corona’s speech lasted for 3 hours, debunking all allegations being hurled against him in the past 5 months of the trial. He enumerated several issues which according to him are lies and results of fabricated evidences by the current government. He again reiterated that his impeachment was brought about by “Hacienderong Pangulo’s” vengeance to their decision of giving back Hacienda Luisita to the farmers. He also denied the testimony of Ombudsman Conchita Carpio-Morales which he earlier called “lantern of lies”, saying he has no 82 dollar accounts but only 4 since most of them were already closed. In answering why he didn’t include it to his Statement of Assets, Liabilities and Net Worth, he invoked the provisions on the Bank Secrecy Law which according to him is absolute. With regards to the peso accounts which according to him was not 31 but only 3, he explained that those were shared accounts meaning those were not his sole money thus should not be part or should not be included in his SALN.

After his lengthy statement, towards the end, he showed a waiver where he signed in-front of the public which will open all his bank accounts for scrutiny but to the condition that all the 188 impeachment complainants and Sen. Frank Drilon will also sign the same waiver for their bank accounts. After that challenge, he addressed the people and the court that “He is the Chief Justice and he needed to be excused”, then walking out of the court without officially being discharged.

This action of the Chief Justice caused commotion in the Senate Impeachment Court and caught the ire of the presiding judge who eventually asked the Senate Sgt at Arms to block all exits in the Senate and asked the defense panel to brought back the Chief Justice to the court.

After several minutes, Corona came back to the court in a wheelchair because according to his lawyers he suffered from hypoglycemia brought about by not eating lunch. On that moment lead defense counsel apologized to Enrile saying the actions of their client was not planned and in no way an act to disrespect the impeachment court.

Enrile accepted the apology but cautioned Corona’s lawyer’s that he wants respect to be accorded to the court as he accorded to the Chief Justice. He also commanded the defense panel to present Corona tomorrow for cross-examination or else he may be moved to strike-out all the statements issued by Corona in today’s trial.

Corona to sit at the Witness Stand

The much awaited part of the Corona Trial will now come to realization as the Chief Justice’s lawyer confirmed that he will be testifying in the ongoing impeachment trial. Defense lawyer Atty. Jose Roy said they will present Chief Justice Renato Corona as their witness in the condition that several hostile witnesses, including Ombudsman Conchita Carpio-Morales will also be presented in relation to Corona’s alleged million dollar bank deposits.

This is a welcome development in the seemingly lame presentation of the defense panel in the ongoing impeachment of the chief magistrate. In the several weeks that they’ve presented witnesses in defense to the accusations of the prosecution, there have been no solid arguments that will debunk his improper disclosure of his Statement of Assets, Liabities and Net Worth (SALN). It is very evident that the Senator Judges are getting impatient with the “peripherals” and “immaterial” witnesses being presented on the witness stand.

Now that the accused himself will testify, it will be a great chance for the defense to answer all the accusations, because there’s no more credible defense witness but the accused himself. Since the case is all about the CJ’s SALN there will be no more perfect person to answer about its discrepancies but he himself. Should they’ve presented him earlier, I think the trial will be on its final part now.

I don’t want to insinuate but I think the defense is loosing cards at this point and they can no longer find any valid and clear defense with regards to the Article 2 so they don’t have any choice but to present the Chief Justice. But I think it’s a good tactic to have him testify because he has the direct knowledge of it. If he will be able to explain anything about his SALN and its discrepancies and it will be that convincing, that will definitely sway the tempo of the trial. I just hope that indeed he has that bullet to fire-out all those accusations leveled against him, because as of now his defense wasn’t able to totally counter the charges being laid by the prosecution panel.

Day 13: The Fariñas Relief (Corona Impeachment Trial)

It was Day 13 of the Impeachment Trial of Chief Justice Renato Corona and this day because of the pending ruling on the motion for the subpoenas regarding Corona’s bank accounts the prosecution proceeded with the presentation of the Article 3 instead of the continuation of the Article 2.

The prosecution presented a witness from the FASAP Mr. Roberto Anduiza, who testified regarding the “flip-flopping” issue of the Supreme Court concerning their case against the Philippine Airlines (PAL). He said the Chief Justice influenced the decision resulting to the reversal of the previous decisions being made by the SC. Meanwhile the Defense postponed its cross examination saying they still need time to study the documents with regards to Anduiza’s testimony to which the prosecution objects but the presiding jusdge overruled the objection in favor of the defense.

But what’s more notable about day 13 is one of the public prosecutors and Ilocos Representative Rudy Fariñas’ comic relief during his response to senate president and presiding judge Juan Ponce Enrile’s question on the relevance of the SC’s financial records to the Article 3. Their exchange of opinions took a little while which became some sort of relief and light moments at the senate.

But the highlight of it was, when Sen. Jinggoy Estrada asked Fariñas if he signed the impeachemt complaint to which Fariñas answered no. Because according to him he wasn’t able to read the entire complaint as he was not a fast reader unlike his colleagues in the congress. And what’s really notable about Fariñas’ moment is his statement “medyo masama rin po kasi yung pagkagawa ng konti eh, hindi na ako pumirma” which ellicited laughter from the Senators and the gallery as well.

Some observers commented it was a blow to the prosecution because one of it’s prosecutors admitted that the complaint was not masterfully crafted. But the prosecution insisted that Fariñas only spoke of his observations and it doesn’t mean he dont believe in the complaint. They said what’s important is the substance and content which is strong enough to convict and strip Renato Corona of his post as Chief Justice of the land.
